PAMPLONA- Electronic auctions of real estate, furniture and vehicles are practically deserted in Navarra. Last October, it was one year since this system was launched through the Internet, which substituted bids in the courts, in order to try to promote the sale of assets in foreclosure or foreclosures.

However, although it seems that since their entry into force the bidders have acquired more goods, the percentage over the total of auctions is still low, about 5%. "In the process of the auction only the act itself has changed, since the regulations have not changed," recalls José Alonso, lawyer (former court clerk) of the Court of First Instance number 6 of Pamplona.

Currently, the web portal shows in Navarra the auction of 39 real estate, almost 67% housing and the rest business premises or ships, whose creditors claim almost five million euros, although the value of the auction of said assets amounts almost to eight million, as can be seen in the information provided by the auction portal of the Official State Gazette (BOE). Most of the properties are detected in Pamplona and its region, although they also appear in other areas such as Falces, Ribaforada, Murillo El Fruto or Viana. 74% of the creditors are financial entities and 10% are individuals or companies.

The portal is constantly updated and including the new auctions of the different goods. "Most of them are homes, and on some occasion cars have been sold, but very few," recalls Alonso. WHAT IS THE PROCEDURE? When the value of real estate, furniture or tourism has been assessed, the corresponding Court collects the information to carry out the auction: the amount claimed, its value -which does not have to coincide with the debt-, the amount of the deposit , the description of the property, where it is located, if it can be visited or not, who is the creditor and if it has received bids. In the event that someone has offered a quantity of money for that good, only the bidder has information of the maximum offer. Once the Court has completed the form, it sends it to the BOE portal, which manages the auction. Before publication, the creditor must pay a fee, "not very high," Alonso recalls, for activation. Once this process has been completed, the auction begins, which lasts 20 calendar days because, as it is a state website, the holidays are not the same in Spain. "There are not usually many bids: now something else moves, but a 20-story building is sold," says this lawyer from Pamplona.

Anyone can access the portal and participate in the bid, but to do this you must register and give your current account number, since at the time you launch an economic offer, the portal deducts from that account 5% of the appraised value of the property . The bid must exceed 70% of the appraised value, and the auctioneer can keep his bid, which is called "reserve stance", qualifies Alonso. And is that if the person who has made the maximum bid does not pay, the next on the list can choose to stay well said. After 20 days, the Court consults the bids, and automatically approves the operation if it has verified that the entire process has been carried out correctly. "At that time, the auction portal sends the deposit to the corresponding court account, and the auctioneer is given a period of 40 days to pay the remaining amount," explains Alonso. Once the money is entered "the decree of adjudication of the good is issued so that it can go to the registry of the property and register it in its name", specifies.

These goods may have loads or be free of them, and that information is also communicated to the auctioneer. "When the auction price is removed, the charges are not included. Therefore, the person who buys the property must assume those charges prior to the auction, "says this lawyer.

WHAT HAPPENS IF THERE IS NO OFFER However, "the auctions are deserted most of the time," confesses Alonso. In this case, the creditor - who in a significant percentage are financial entities - has 20 days to bid for the good. "If it is a habitual residence, it must be kept for a minimum of 70%, even if the debtor owes less than that amount, the creditor can bid for 60%," he clarifies. In the event that the property is not the usual, the minimum percentage is established at 50% of the appraisal.

Since October of last year, the Courts work with the electronic auction, which as Alonso recalls arose from the initiative of a colleague from Murcia: "It occurred to him to carry out the auctions over the Internet and it was observed that he was more successful than the others that we did not sell nothing. He started collaborating with the Ministry and they worked to get to the current tool. " But, although one of the objectives sought to encourage the sale, in these fourteen months the auctions have practically been deserted in the absence of bidders.
